TERMS OF USE

 

1. Preamble

 

These Terms set out the use of the services of the online platform operating under the address www.milq.gr(hereinafter the “Website”) and offered by the company under the corporate name “MILQ I.K.E.”, with registered office at Thrakis 6, Dionysos 14568, with VAT No. 802910054 and GEMI No. 185121301000 (hereinafter the “Company” or “MILQ”).

 

By accessing or using the Website, the user is presumed to unreservedly accept these Terms of Use. The use of the services in no case creates an employment relationship, partnership relationship, representation, or joint venture between the user and the Company.

 

The Company does not guarantee the continuous and uninterrupted operation of the Website, which may be affected by external factors or reasons of force majeure.

 

 

2. Privacy and Data Protection

 

The processing of personal data is governed by the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679), Law 4624/2019 and the Company’s Privacy Policy.

 

The collection, storage and processing of personal data takes place only for lawful purposes and in accordance with the Privacy Policy. The Company reserves the right to amend the Privacy Policy following compliance with applicable legislation.

 

Users may exercise any of their rights (e.g. access, rectification, erasure of personal data) by sending a relevant request to the email address privacy@milq.gr, through the email with which they have registered. The text of the email should include Full Name and mobile phone number for identity verification where required.

 

 

3. User Registration and Accounts

 

Access to the Website and use of the services presuppose acceptance of these Terms. Users may create an account by registering with email and setting a personal password.

 

Upon registration, the information provided must be:

• Accurate and true

• Compatible with applicable legislation

• Free of malicious content or code

The Company reserves the right:

• To block or delete accounts that violate the Terms

• To prohibit re-registration without approval

• To take legal action in cases of misleading or harmful use

 

 

4. Role of MILQ

 

The Company operates as an online intermediation platform (marketplace), facilitating the conclusion of sales contracts between consumers and independent merchants. MILQ is not a seller and does not become a contracting party to the sales contract.

 

Delivery of products to the consumer is carried out through a cooperating courier company, with which MILQ maintains a contractual relationship for the purposes of organizing and executing the shipment.

 

Nevertheless, each merchant remains exclusively responsible vis-à-vis the consumer for the proper performance of the sales contract, including timely delivery, the conformity of the products and the issuance of the lawful supporting documents, in accordance with the applicable consumer protection legislation.

 

MILQ bears no liability for delays or delivery failures attributable to the merchant or to circumstances of force majeure, without prejudice to the consumer’s rights arising from mandatory provisions of law.

 

Each merchant is responsible for:

• Issuing the supporting document (receipt or invoice)

• Indicating product and price details

• Complying with the legislation on distance sales (Law 2251/1994)

MILQ reserves the right to remove or restrict content in accordance with the Compliance Policy with the Digital Services Act (DSA).

 

 

5. Transaction Terms

 

The information transmitted by the Website to its users regarding the products displayed on it per thematic category is purely of an informative nature and purpose. The Company in no case bears liability for compensation or redress of any direct or indirect loss and positive or consequential damage, even future, which may have been caused due to that information.

 

Furthermore, the Website bears no liability as to the accuracy and correctness of the above transmitted information, as this is information collected either from the manufacturers of these products or as information transmitted by the stores that offer them for sale.

 

The Company is not liable for any inaccuracies due to information provided by cooperating stores or manufacturers, unless wilful misconduct or gross negligence on its part arises, without prejudice to the consumer’s rights arising from mandatory provisions of law.

The display of search results (product – price – store) depends on the correct use of keywords as well as on the product description by the stores. The ranking and display of search results is based on objective criteria, such as product availability, the information provided by the stores and technical parameters of the platform and, where the user has selected use of location, the proximity of stores. Any promoted listings or commercial displays are marked with a clear indication.

 

It is noted that many products made available by domestic stores that trade products from abroad are very likely to differ in characteristics from the corresponding products intended for the Greek market.

Indicatively, there may be differences in sizing systems (e.g. international, Italian, French, British or others), in fit, in lines and in product proportions. For reasons of facilitation and uniform presentation, the Website converts and displays all sizes on its platform in the European sizing system (EU sizing). However, consumers must carefully refer to the detailed information of each product, such as description, size charts, fit notes or any special clarifications of the store, before completing the purchase. Size selection is made at the consumer’s responsibility, taking into account that deviations may exist due to the manufacturer or the country of origin of the product.

 

Use of Artificial Intelligence Tools

 

MILQ may provide cooperating stores with artificial intelligence (AI) tools to assist in the creation or optimization of product descriptions, titles, features or other commercial content.

These tools operate exclusively in a supportive manner. Each store remains exclusively responsible for the accuracy, completeness and legality of the information published on the platform, as well as for the final confirmation of the content prior to its publication.

MILQ bears no liability for inaccuracies or omissions arising from content created or assisted by AI tools and approved by the store, unless wilful misconduct or gross negligence on its part arises, without prejudice to consumers’ rights arising from mandatory provisions of law.

MILQ may use artificial intelligence (AI) tools and automated technologies for purposes of visual harmonization, presentation optimization and aesthetic consistency of product photos on the platform, such as indicatively adjustments of lighting, background, ratios or alignment of images. Such interventions are not intended to alter the essential characteristics of the products. Nevertheless, consumers are invited to examine all available photos of each product, as well as its detailed description, in order to form a complete and accurate picture regarding details such as color, texture, fit or individual characteristics, before completing the purchase.
The Company does not guarantee that the visual depiction fully matches the physical product.

 

 

6. Orders – Payments – Delivery and Role of MILQ

 

6.a Order Submission

 

Submitting an order through the Website entails an obligation to pay on the part of the consumer.

After completion of the purchase process, MILQ sends an electronic order confirmation and transmits the relevant details to the cooperating store(s). The cooperating stores confirm availability and proceed with execution of the order.

Electronic payments are completed in a secure environment of the National Bank of Greece (NBG). MILQ does not store nor process full payment card details.

The order may include products from different stores. In this case, shipments are carried out separately per store and may differ as to delivery costs and delivery times, as displayed to the user prior to completion of the purchase.

 

6.b Delivery

 

Shipment of products is carried out through cooperating courier companies. Indicatively, for shipments within Greece, MILQ cooperates with the company EasyMail or other cooperating carriers.

Estimated delivery times are:

• 1–3 business days within Attica

• 3–7 business days outside Attica

The above times are indicative and may change due to factors beyond the control of MILQ and/or the store, such as indicatively force majeure, strikes, extreme weather phenomena or carrier delays.

Responsibility for proper performance of the sales contract, including delivery of the product, lies with the respective store, in accordance with the applicable consumer protection legislation.

 

6.c Payments & Role of MILQ

 

Payment of orders is carried out through the MILQ platform in a secure environment of the National Bank of Greece (NBG), for reasons of convenience and unification of the payment process.

MILQ acts exclusively as an intermediary and collection mandatary on behalf of the cooperating stores. Completion of payment through the platform does not render MILQ a seller nor a contracting party to the sales contract.

The sales contract is concluded directly between the consumer and the respective store, which bears exclusive responsibility for:

• issuance of lawful tax documents,

• conformity of the products with applicable legislation,

• proper execution and delivery of the order.

 

6.d Methods of Payment

 

Payment of orders is carried out through the MILQ platform with the following payment methods: credit and debit cards (Visa, Mastercard and other supported schemes), Apple Pay, Google Pay and IRIS Online Payments.

All payments are processed in a secure banking environment of the National Bank of Greece (NBG) and are subject to the terms and conditions of the respective payment provider. MILQ does not store nor process full payment card details.

Availability of specific payment methods may vary depending on the device, operating system and/or the technical specifications of the user.

 

 

7. Right of Withdrawal (14 Days)

 

The consumer has the right to withdraw within 14 calendar days from receipt of the product without obligation to provide reasons, in accordance with Law 2251/1994 and Directive 2011/83/EU. Any return cost burden is regulated more specifically in the Returns Policy.

The relevant declaration must be submitted through the Website and the return procedure must be followed as described in detail in the “Returns Policy” of the Website. The Company informs the merchant and assists in the process of product return and refund respectively. The product must be returned in a condition that allows inspection of the nature, characteristics and functioning of the product, with all tags where applicable, in accordance with applicable legislation and the Returns Policy.

The option to receive a voucher, where provided, is optional and does not limit the right to a refund.

Refunds are carried out in accordance with the withdrawal legislation and in any case within the lawful time limits, with the possibility of suspension until the product is received or proof of dispatch is provided.

8. Limitation of Liability

 

The Company bears no liability for:

• Content uploaded by stores

• Incorrect information or product characteristics

The Company is not liable for acts or omissions of cooperating merchants, nor for the quality, safety or compliance of products with applicable legislation, as it is not the seller of those products.

The Company’s liability is limited to cases of wilful misconduct or gross negligence, in accordance with applicable consumer protection law. Nothing in these Terms limits or excludes consumers’ rights provided by mandatory provisions of law.

The intellectual property rights of the Website belong to the Company. Republishing, reproduction, in whole or in part, including summary, paraphrase or adaptation of the Website’s content by any electronic, mechanical or photocopying means, is prohibited without prior written permission.

The Company, its lawful representatives or its employees are not liable for any damage, positive or consequential, which is due exclusively to acts or omissions of cooperating stores or third parties, unless wilful misconduct or gross negligence on its part exists.

 

 

9. Minors

 

The services of the Website are not addressed to persons under 15 years of age. If you are under 15, parental consent is required. The Company does not knowingly collect data of minors. In case of violation, please contact us via email at privacy@milq.gr.

 

 

10. Final Provisions

 

The Website and its content are protected by intellectual property rights. Any use, reproduction or republication is permitted only with written permission.

These Terms are governed by Greek law. For consumers, any disputes are resolved by the competent courts in accordance with mandatory provisions of law and the jurisdiction rules applicable in favor of the consumer.

 

 

11. Complaints Management & User Support

 

Users may contact the Company’s support team for any issue concerning use of the Website, potential violations or order service via the email address: support@milq.gr.

The Company makes every possible effort to mediate in disputes between consumers and merchants, without however bearing legal liability for the final outcome or for the quality of the products.

Complaint management is governed by the principles of impartiality, transparency and prompt service. If requested by competent authorities or if a court order arises, the Company is obliged to provide the relevant information.

 

 

12. Amendment of Terms of Use

 

The Company reserves the right to amend these Terms of Use at any time. Amendments take effect from the moment they are published on the Website, and continued use of the services by users constitutes acceptance of the new terms.

In the event of material changes, users will be notified via email or by a notification upon logging into the Website. Users are encouraged to review the Terms regularly.

 

 

13. Gift Vouchers / Gift Vouchers

 

MILQ Gift Vouchers are digital and may be used exclusively on the MILQ platform.

Each Gift Voucher has a validity period of twelve (12) months from the date of purchase. After expiry, the Gift Voucher cannot be used, refunded or reactivated.

Gift Vouchers may be used partially or in full.

If the order value is lower than the Gift Voucher value, the remaining amount will be issued as a new MILQ Gift Voucher, with the same expiry date as the original, unless otherwise provided.

If the order value exceeds the Gift Voucher value, the user must pay the difference through the available payment methods at checkout.

Gift Vouchers are not refundable, are not exchangeable for cash and cannot be resold or transferred.

MILQ bears no liability for loss or unauthorized use of a Gift Voucher code.

MILQ reserves the right to amend or discontinue the Gift Voucher program, provided that already issued Gift Vouchers will remain valid and may be used normally until their expiry date.

MILQ Gift Vouchers constitute a limited-use payment instrument within the MILQ platform and do not constitute electronic money within the meaning of applicable legislation.
